In Memoriam: Pete Torrey (1947-2024)

CCAR is saddened to announce the passing of longtime member Pete Torrey, who joined in 1977. Pete earned the distinguished titles of CCAR Honorary Member for Life and C.A.R. Honorary Member for Life. As a respected broker, he was highly regarded by his peers and known for his kindness toward CCAR staff. Pete was an enthusiastic participant in the annual CCAR golf tournament and often visited the office to research properties in the days before the MLS went online. One of his proudest achievements was leading CCAR’s ‘Save Our Sports’ campaign, which protected local high school sports from budget cuts in the 1990s.

A celebration of Pete’s life will be held on Thu., Sep. 26, at 11am, followed by a reception at St. Matthew Lutheran Church, 399 Wiget Lane, Walnut Creek.

Market Update

The market has been relatively quiet in the lead-up to the Federal Reserve’s meeting on interest rates next week. Although recent economic data remains relatively strong, markets remain optimistic that the key policy rate will be cut by the Federal Open Market Committee. This has already begun to have a positive impact on the market as signs of homebuyer demand have perked up in recent weeks. However, prices continue to rise as well and that has helped to keep homebuyer sentiment restrained. The full benefit of lower rates will continue to play out in the coming months, but fortunately, the anticipated uptick in demand is also poised to be met with additional inventory, which is also slowly being unlocked as interest rates normalize.

Display Master Lock Lockboxes
On both web and mobile app platforms, when a Master Lock lockbox is added as a listing’s Access Type in the Showing Configuration page, it will not appear on the Lockboxes page until the listing’s Showing Configuration page is saved. We have identified and resolved this issue and newly added Master Lock lockboxes will appear for users to further manage via the Lockboxes page.

No CSRF Token Found
A user reported encountering a CSRF token error when attempting to book a showing via MLS. Upon investigation, it was determined that the issue stemmed from the CSRF cache not being cleared in response to a 500 error. This issue will be addressed and resolved in the upcoming release.

Removal of “Concessions Considered: Yes/No” Field
from Listing Entry

Effective today, August 27, we will be removing the ‘Concessions Considered: Yes/No’ field from Listing Entry. This decision comes as a precautionary measure following recent litigations and legal advice.

Initially, we made this field mandatory to eliminate potential confusion in listing reports by ensuring a clear “YES” or “NO” was displayed. However, after listening to feedback from our members, we understand that this requirement may not have aligned with everyone’s business needs.

As an MLS, our primary duty is to protect you and your data. We appreciate your understanding and patience as we navigate the current challenges in our industry and strive to serve you better. Thank you for your continued support.

Stay Compliant: Master the New and Updated Forms with C.A.R.’s Legal Updates and Free Classes

In July several new and updated standard forms were released in zipForm and other platforms. To ensure you are in compliance with the mandates of the NAR settlement, join C.A.R.’s legal staff for a live update on how to properly use these forms. It is imperative that CCAR members are ready to use the new forms and prepared to discuss the changes with their clients. 

Additionally, C.A.R. Education is offering two new classes: a Buyer Representation Form class and a Residential Listing Form class. Members can access these classes for FREE by logging into store.car.org and entering “FORMS49” at checkout.

Starting Wed., Aug. 21, the “Concessions Considered” field will be changing from optional to required. This adjustment was implemented to prevent any potential confusion in listing reports. Previously, if the field was left unanswered, the presence of the field name “Concessions Considered” in the report could imply that sellers might consider concessions. By making this field mandatory, we ensure that a clear “YES” or “NO” will be displayed, eliminating any ambiguity. Participants, Subscribers, and their sellers are prohibited from making offers of compensation to buyer brokers and other buyer representatives in the MLS. Participants and Subscribers are prohibited from disclosing in the MLS, in any way, the total commission negotiated between the seller and the listing broker, or total broker compensation (i.e. combined compensation to both listing brokers and buyer brokers). The MLS reserves the right to remove a listing from the MLS database that does not conform to the requirements of this section. This rule does not prevent sellers from offering buyer concessions on the MLS so long as such concessions are not limited to or conditioned on the retention of or payment to a Buyer Broker or other buyer representative.
