Code of Ethics Violators

In an effort to make ethics violations and the disciplinary process more transparent, C.A.R. is publishing the names of members who are found in violation of the Code of Ethics as well as summaries of the members’ unethical behavior.

Member publication is triggered only if the discipline imposed is a reprimand, fine, suspension or expulsion – anything other than a letter of warning or stand-alone education. The information will be published on the members-only section of car.org.

CCAR Member Benefit: Zillow Rental Syndication – Free Beginning Next Wednesday!

Beginning January 18th, CCAR MLS Participants may leverage a new CCAR Benefit. MLS Participants will have the option to opt-in to syndicating their brokerages “Lease Rental” listings to Zillow.com at no cost. Historically, there has been a cost to any lease rental listing agent to gain publication of a rental listing on ZIllow.com.

CA Dept. of Insurance Creates One-Stop Resource
for Wildfire Info.

The California Department of Insurance has created a “one-stop” resource for wildfire information on its Wildfire Response and Readiness web page. Through its Wildfire Data and Analysis on Wildfires and Insurance, the Department can identify trends affecting the insurance market.

The page includes:
1.   Annual residential insurance policy count data from 2015-2021
2.   Wildfire risk reporting information
3.   Statewide commercial data
4.   Insurance companies currently offering home and community hardening
incentives
5.   “Home Insurance Finder” for insurance companies that write in higher fire
risk areas, among other information

MLS Rule Changes (12.15.1 & 12.15.2)

Today, January 3rd, the 12.15.1 and 12.15.2 MLS Rules & Regulation changes will go into effect. These changes are being made as recommended by C.A.R.

Rationale: The two rules conflict with the Model MLS Rule 11.16, as revised in October 2021, which requires MLSs to permit MLS Participants & Subscribers to share the listing broker’s offer of compensation in IDX and VOW displays, and supports greater transparency in sharing the offer of compensation.

Licensees with a renewal date of January 1, 2023, or later are required to take an Implicit Bias course and an Interactive Fair Housing course as part of their 45 hours of CE. Please note that: If the licensee has completed their 45 hours in 2022 with the former CE package and old coursework but their license isn’t required to be renewed until 2023, they will still be required to take these two new courses even if they already have taken the 45 required hours. FREE AT HOME COVID TESTS

Recent DRE Changes to License Renewal Requirements for January 1, 2023 or Later

Licensees with a renewal date of January 1, 2023, or later are required to take an Implicit Bias course and an Interactive Fair Housing course as part of their 45 hours of CE. Total required 45 hours of CE remains the same.

DRE Renewal Guidelines

Licensees with a renewal date of 1/1/23 or later
Must submit CE coursework that includes the interactive Fair Housing
and Implicit Bias coursework. If the licensee has completed their 45
hours already with the former package and old coursework, they will be
required to take these two courses also.
Licensees with a renewal date prior to 1/1/23
May submit the new coursework in Implicit Bias and the Interactive
Fair Housing for credit and it will be accepted even though these
courses are not required prior to 1/1/23
OR
May submit the previous coursework PRIOR to 1/1/23 even though it
does not include the two new courses.
Licensees with a renewal date prior to 1/1/23 that submit renewal information after 1/1/23 – (Late Renewals)
These agents will be required to submit the new coursework in Implicit
Bias and the Interactive Fair Housing Course.

MLS Rule Changes (12.15.1 & 12.15.2)

On January 3rd, the below MLS Rules & Regulation changes will go into effect. These changes are being made as recommended by C.A.R.

Rationale: These two rules conflict with the Model MLS Rule 11.16, as revised in October 2021, which requires MLSs to permit MLS Participants & Subscribers to share the listing broker’s offer of compensation in IDX and VOW displays, and supports greater transparency in sharing the offer of compensation.

12.15.1 Copies to Prospective Purchasers. Broker participants and real estate subscribers may reproduce from the MLS compilation, and distribute to prospective real estate purchasers, copies of those portions of the MLS compilation consisting only of non-confidential fields ~~a description of the property, including the address, features, financing and price.~~ Such “client copies” shall also comply with the following:

a. Permissible MLS data may be augmented with additional data not otherwise prohibited from display, provided the source of any additional data is clearly identified.

b. No more than 500 current and 500 sold listings may be provided in response to any inquiry.

c. A disclaimer statement shall be made in a manner readily visible to consumers but not less than 7pt type, that contains the following, or substantially similar, notice:

Based on information from the Contra Costa Association of REALTORS® MLS as of _____ (date the AOR/MLS data was obtained). All data, including all measurements and calculations of area, is obtained from various sources and has not been, and will not be, verified by broker or MLS. All information should be independently reviewed and verified for accuracy. Properties may or may not be listed by the office/agent presenting the information.

12.15.2 Information Prohibited from Reproduction/Confidential Fields. Unless the participant or subscriber obtains prior written consent from the listing broker, the information reproduced pursuant to this section shall not include the following:

a. Property owner’s name, phone number, and address (if different than the listed property);

b. Instructions or remarks intended for buyer brokers, including but not limited to showing instructions or security references (ex: lock box, burglar alarm or security system, vacancies) regarding the listed property:

c. Type of listing;

~~d. Compensation or bonuses offered to buyer brokers;~~

ed. Expired or withdrawn listings;

fe. Other confidential fields ~~information that goes beyond a description of the property~~.
