Senate Confirms Frank Cassidy for Federal Housing Role

The United States Senate confirmed Frank Cassidy to serve as the Assistant Secretary for Housing and Federal Housing Commissioner at the Department of Housing and Urban Development (HUD). In this role, Cassidy will lead HUD’s Office of Housing and oversee the Federal Housing Administration’s (FHA) Single Family, Multifamily, and Healthcare mortgage insurance programs.

FHA supports a $1.9 trillion portfolio and holds a critical role in the nation’s housing finance system and healthcare infrastructure.

Prior to joining HUD, Cassidy built a distinguished career in major commercial mortgage banking and real-estate finance, advising developers, owners, and investors across the multifamily, senior housing, and healthcare sectors. For more than 15 years, he originated and closed billions of dollars in FHA, Fannie Mae, Freddie Mac, bridge, and balance-sheet financing.

Cassidy joined HUD in April 2025 as the Principal Deputy Assistant Secretary for HUD’s Office of Housing and FHA, where he carried out Secretary Turner’s directive to streamline processes, strengthen risk management, and improve how FHA serves its borrowers and private-sector partners.

CA Law – Sexual Harassment Training Required Every 2 Years

Reminder: State law requires Designated Brokers to complete supervisory sexual harassment training and provide employees with access to training.

Additionally, salespeople, brokers, broker associates, and independent contractors are now personally liable for sexual harassment in professional relationships with clients—even if the relationship has ended.

Risk Management Tip:
The responsible broker and anyone supervising agents or employees—including those who hire, fire, reward, or discipline—should also complete supervisory training.

MLS Rule Changes Effective January 1, 2026
New Law: AB 723 – Disclosure Required for
Digitally Altered Property Images

Effective January 1, 2026, California Assembly Bill 723 requires real estate professionals to clearly disclose when images used in advertising or listings have been digitally altered and to provide access to the original, unaltered images when those altered images are made public.

Two new sections will be added to the CCAR MLS Rules and Regulations Effective Jan. 1. 2026

  • 11.5.1 Definition of Digitally Altered Images – Defines digitally altered images as provided under California law.
  • 11.5.2 Digitally Altered Images – Explains how digitally altered images must be treated when inputted in the MLS.

How Does this Affect Photograph Requirements in the MLS?
To support compliance with California’s new law regarding digitally altered property images (AB 723), CCAR will be implementing a standardized approach within the MLS.

Going forward, when a digitally altered image is used in a listing:

  • The digitally altered image must be displayed first,
  • The original, unaltered image must immediately follow, and
  • The altered image must include a photo label clearly disclosing that the image has been digitally altered.

To add a photo label within the MLS, please follow the instructions below:

  • Go to ‘Maintain Listing’;
  • Go to the ‘Add/Edit Pictures’ module;
  • Add listing photos and select ‘Add Label’ for the digitally altered images;
  • Type into the ‘Label’ field that the photo is digitally altered (i.e. “altered,” “digitally altered,” “AI altered,” or some accurate substantially similar term).

This approach allows the MLS to clearly present both versions of the image while maintaining transparency for consumers and consistency for Participants and Subscribers.

CCAR Helping Hands Fund Supports Local Charities This Holiday Season

The CCAR Helping Hands Fund continues to make a meaningful impact in our local community, providing support to organizations that serve neighbors in need, especially during the holiday season.

This season, Helping Hands donated to three local nonprofits, including $2,000 to the Food Bank of Contra Costa and Solano, $1,000 to Monument Crisis Center, and $1,000 to White Pony Express. These contributions helped ensure families had access to nutritious food, holiday meals, and essential resources during a time when demand for assistance is especially high.

The Food Bank of Contra Costa and Solano shared that the donation helps strengthen the community’s critical safety net, particularly as many households face food insecurity and disruptions in benefits such as CalFresh. Monument Crisis Center expressed gratitude for the support, noting that the contribution helped bring smiles to clients receiving holiday food boxes and supports their mission of promoting stability, healthy living, and empowerment. White Pony Express similarly works to nourish vulnerable populations and strengthen the community through food rescue and distribution.

The Helping Hands Fund is made possible through the generosity of CCAR members, whose commitment to giving back helps uplift local nonprofits and the people they serve. These donations reflect CCAR’s ongoing dedication to supporting our community and making a positive difference beyond real estate.

A new survey from the National Association of REALTORS® reveals growing concern over title fraud and deed theft, especially in urban and suburban markets.

C.A.R. Releases New Standard Forms

With referral fees receiving increased attention across the industry and in the media, C.A.R. last week has released several forms to help clarify and simplify disclosure requirements. Among the updated forms include the REALTOR® Acknowledgement and Disclosure Form (RAD). The revised RAD provides a standardized and transparent way to disclose referral-related compensation and other applicable disclosures.

To support members in understanding and using the revised forms, C.A.R. has created several new resources, including a Legal FAQ, several Quick Guides and Legal Live Webinar videos about referral fees and the RAD form. The FAQ explains when the form should be used, what information must be disclosed, and how the revisions align with current legal requirements.

FHA Loan Limit Increases to $1.25 Million in 2026

The Housing and Urban Development’s (HUD) Federal Housing Administration (FHA) said it will raise the maximum claim amount for its Single-Family Forward and Home Equity Conversion Mortgage (HECM) mortgage insurance programs to $1,249,125 in 2026, up from $1,209,750 this year.

FHA updates its loan limits every year based on rules in the National Housing Act. These limits are calculated using home-sale data from each county or metropolitan area. The law sets three cost tiers, and FHA adjusts the limits according to local home prices.

The law also caps the loan limit in high-cost areas at 150% of the national conforming loan limit, which is set by the Federal Housing Finance Agency for Fannie Mae and Freddie Mac.

The new limit is a 3.3 percent increase of $39,375, marking the 10th straight year of increases.

Loan limits for most of the country will increase due to the continued appreciation of home prices over the past year.

If you’re a member looking to resolve a minor dispute or communication issue with another REALTOR®, a C.A.R. Ombudsman can help! C.A.R. Ombudsmen are REALTORS® who volunteer their time to answer non-legal questions and resolve non-legal disputes. 

C.A.R. Ombudsman aim to enhance communication among REALTORS® and can propose resolutions for minor issues raised by clients or other members, avoiding escalation. Some common grievances include claims of possible ethics violations and communication issues, such as misrepresentation and lying, as well as complaints surrounding cancellation of a contract, listing, or escrow.

New Law: AB 723 – Disclosure Required for Digitally Altered Property Images

Effective January 1, 2026, California Assembly Bill 723 introduces new disclosure rules for real estate professionals who use digitally altered images in advertising, marketing, or online listings. The new law requires that a clear disclosure be present on or near the image stating that it has been digitally altered. It is also required to provide access to the original, unaltered version of the image when made publicly accessible.

Why This Matters
AB 723 adds Section 10140.8 to the California Business & Professions Code. It applies to licensed real estate brokers and salespersons and those acting on their behalf.

What Counts as a “Digitally Altered Image”?
According to the recently revised C.A.R. Model MLS Rules:
“Digitally altered image” means an image, created by or at the direction of the real estate broker or salesperson, or person acting on their behalf, that has been altered through the use of photo editing software or artificial intelligence to add, remove, or change elements in the image, including, but not limited to, fixtures, furniture, appliances, flooring, walls, paint color, hardscape, landscape, façade, floor plans, and elements outside of, or visible from, the property, including, but not limited to, streetlights, utility poles, views through windows, and neighboring properties. “Digitally altered image” does not include an image where only lighting, sharpening, white balance, color correction, angle, straightening, cropping, exposure, or other common photo editing adjustments are made that do not change the representation of the real property.
