Stay Compliant: Master the New and Updated Forms with C.A.R.’s Legal Updates and Free Classes

In July several new and updated standard forms were released in zipForm and other platforms. To ensure you are in compliance with the mandates of the NAR settlement, join C.A.R.’s legal staff for a live update on how to properly use these forms. It is imperative that CCAR members are ready to use the new forms and prepared to discuss the changes with their clients. 

Additionally, C.A.R. Education is offering two new classes: a Buyer Representation Form class and a Residential Listing Form class. Members can access these classes for FREE by logging into store.car.org and entering “FORMS49” at checkout.

Important Update: New Required Field for Listing Entry Begins Tomorrow

Starting Wed., Aug. 21, the “Concessions Considered” field will be changing from optional to required. This adjustment was implemented to prevent any potential confusion in listing reports. Previously, if the field was left unanswered, the presence of the field name “Concessions Considered” in the report could imply that sellers might consider concessions. By making this field mandatory, we ensure that a clear “YES” or “NO” will be displayed, eliminating any ambiguity. When updating active or pending listing that have not previously selected an option for this field, users will be prompted to provide an answer. If you have any questions contact CCAR Member Services at [email protected].

The MLS reserves the right to remove a listing from the MLS database that does not conform to the requirements of this section. This rule does not prevent sellers from offering buyer concessions on the MLS so long as such concessions are not limited to or conditioned on the retention of or payment to a Buyer Broker or other buyer representative.

Communicating with Consumers About Class Notice

Be prepared to answer questions from consumers about the pending “class notice.” The class notice is a court-approved process through which members of the “Settlement Class”—home sellers who sold a home during the eligible date ranges, the home was sold on an MLS anywhere in the U.S., and paid a commission to a real estate brokerage in connection with the sale of the home—will be informed about NAR’s proposed settlement of the Sitzer-Burnett case.

Notices will be distributed by mail and electronically. Class notice informs class members of their rights, options, and deadlines to exercise those rights and options under the proposed settlement.

Consumers in your area may have already received a notice regarding separate settlements made by certain brokerage firms; however, this notice will be new and address NAR’s settlement.

IMPORTANT NOTE: NAR does not manage the class notice process. NAR members that receive questions from consumers should direct them to the settlement website where they can find relevant information. You may also direct them to call the settlement administrator at 888-995-0207, for additional guidance. NAR members should refrain from further advising consumers on class notice.

The National Association of REALTORS® has launched a CALL FOR ACTION asking Members of Congress to cosponsor H.R. 5419 the Direct Seller and Real Estate Agent Harmonization Act, to ensure real estate agents maintain their independent contractor status under the Fair Labor Standards Act (FLSA).

These system changes reflect the work of the CCAR MLS Management Group (MMG) which has spent the last few months reviewing the rules in their entirety to ensure compliance with NAR and C.A.R. model MLS rules changes resulting from the NAR legal settlement. Ethics Advocates Your Most Valuable Resource in a Dispute

An Ethics Advocate (EA) is a no-cost resource available upon request, supporting complainants and respondents involved in disciplinary proceedings. Ethics Advocates, who are trained Professional Standards volunteers, assist parties throughout the process. They help with concise form preparation, gathering evidence, and can provide support during hearings if requested.

While EAs are not attorneys and cannot practice law, they aid parties in presenting their case effectively, including completing Complaint and Response Forms and identifying relevant evidence. EAs do not act as witnesses during hearings. Although individuals must attend hearings themselves, an EA offers valuable assistance before, during, and and after the hearing. It’s important to note that using an EA does not preclude parties from retaining their own legal representation if desired.

California Latest Market Update – July 29

The economy expanded at a faster pace than expected in Q2, but the latest growth rate could be the highest we will see in the next few quarters. There are signs in recent months that suggest consumers are increasingly tapped out and could pull back further in coming months. An economic slowdown, however, is not necessarily bad news for the housing market. Mortgage rates, in fact, started this week at six-month lows, as the market has become more convinced that the Fed’s rate cuts will begin in September. Home sales should begin to bounce back and improve more consistently in Q3 and Q4.

CCAR Lends a Helping Hand to Disaster Victims

CCAR’s Helping Hands Committee has donated $5,000 to the National REALTOR® RELIEF FOUNDATION (RRF) in support of its 2024 efforts to provide housing relief to victims of hurricanes, floods, wildfires and other disasters.

RRF is a 501(c)(3) nonprofit that provides financial housing assistance to the public following catastrophic disasters. The foundation has donated more than $37 million in aid helping tens of thousands of families across the country.

Every dollar donated goes directly to victims of disasters. The National Association of REALTORS® is pleased to cover 100% of administrative expenses.

New CCRE Report: Unlocking Potential

The Center for California Real Estate (CCRE) has released a new report titled “Unlocking Potential: Tackling the Bay Area’s Housing Supply Challenge.” The Bay Area faces a critical shortage of housing that is driving up prices. This report outlines a summary from a panel of experts, convened by the Center for California Real Estate (CCRE), discussing the barriers to increasing housing supply and proposing solutions to address these challenges.
