Ethics Training Must Be Complete By Dec. 31st

It’s easy to find out if you’re due for NAR triennial ethics training. Just sign in to your NAR account, click your name on the upper right, select “Manage Account” and then the “My Education” tab to check your status.

NAR ETHICS TRAINING REQUIREMENTS – All REALTORS® are required to complete 2.5 hours of ethics training every three years. | Current cycle: 2022-2024. Training must meet specific learning objectives and criteria established by NAR.

If you complete the necessary 45-hours of DRE-required continuing education for your license renewal, offered free HERE through C.A.R., between 1/1/2022 and 12/31/2024, you will automatically fulfill the current NAR triennial ethics training requirement. Failure to complete the required training is a violation of membership duty for which membership is suspended in January 2025 and subsequently terminated. Certified REALTOR® Emeritus members are exempt from the NAR Code of Ethics Training requirement.

Last Month’s Crab Feed Nets Big Catch For Charity!

Members feasted on a sizable catch at CCAR’s annual crab feed last month and raised $11,000 for CCAR Helping Hands and the CCAR Scholarship Foundation as well as $2,000 from a special auction for the Bay Area Rescue Mission. More than 250 CCAR members, affiliates, staff, and their guests enjoyed a buffet of crab and tri-tip while bidding on amazing auctions, raffles, and delicious desserts!

Very special thanks go out to all those who planned and worked the event as well as all those who donate so generously to these important CCAR charities, helping make our events a success!

MLS Rule Change 10.1.1 – Effective April 8th

The following MLS Rules & Regulation change will go into effect April 8th. This change is being made to further clarify the already existing business rules and functionality of the MLS.

10.1.1 Coming Soon Listings.
It shall be the responsibility of the Broker Participant (Section 4.1.1) and Real Estate Subscriber (Section 4.2.1) to follow said rules when placing a property in the Coming Soon section of the multiple listings service (MLS). Broker Participant and Real Estate Subscriber shall only place a property in the Coming Soon sec􀆟on of the MLS if the Participant/Subscriber has met the necessary criteria for MLS input as described in Sections 7.5, 7.6, and 8.1. Participant/Subscriber is required to enter a proposed list date to proceed in placing a listing in the Coming Soon section of the MLS. Once the listing moves from Coming Soon to any Active status it cannot revert back to Coming Soon with that same broker. Open House or Broker Tour is not allowed while in coming soon status.

Are Agents Independent Contractors or Employees?

New Regulations: Effective March 11, 2024 

Under California law, as clarified in 2020 in Assembly Bill 5, a real estate licensee is an independent contractor if:

  • The individual has a real estate license
  • Compensation is based on output rather than hours worked
  • A written contract between the individual licensee and broker provides the individual will not be treated as an employee for real estate services rendered.

CA Law – Sexual Harassment Training Required Every 2 Years

Reminder: State law requires Designated Brokers to complete supervisory sexual harassment training and provide employees with access to training.

Additionally, salespeople, brokers, broker associates, and independent contractors are now personally liable for sexual harassment in professional relationships with clients—even if the relationship has ended.

To stay compliant, C.A.R. strongly recommends completing 1-hour of sexual harassment training immediately and every 2 years thereafter.

Risk Management Tip:
The responsible broker and anyone supervising agents or employees—including those who hire, fire, reward, or discipline—should also complete supervisory training.

Concord City Council Meeting

Rent Stabilization and Just Cause for Eviction
Ordinance – Final Vote

Next Tue., Mar. 5 at 6:30pm, the Concord City Council is scheduled to take a final vote on the draft Rent Stabilization and Just Cause for Eviction Ordinances.

The City Council voted 4-1 to introduce the draft ordinances on Tue., Feb. 13, 2024, which include a rent cap of 3% or 60% of CPI (whichever is lower), rent rollback to Apr. 4, 2023, and relocation assistance for all rentals (including single-family homes). This item is expected to be on consent, but you can still email the City Council your opinion at:

Legal Quick Guide: Are Agents Independent Contractors or Employees? New Regulations: Effective March 11, 2024 

Under California law, as clarified in 2020 in Assembly Bill 5, a real estate licensee is an independent contractor if:

– The individual has a real estate license
– Compensation is based on output rather than hours worked
– A written contract between the individual licensee and broker provides the individual will
  not be treated as an employee for real estate services rendered.

The CCAR Scholarship Foundation provides scholarship awards of up to $10,000 to qualified students residing in Contra Costa County. Their commitment to support higher education is the heart of the Foundation’s desire to make a difference!

Tempering Mortgage Rates Propel
California Home Sales in January

California existing home sales rebounded in January to the highest level in six months as mortgage rates pulled back sharply at the end of 2023, according to C.A.R.’s January home sales and price report.

Existing, single-family home sales totaled 256,160 in January on a seasonally adjusted annualized rate, up 14.4 percent from 224,000 in December and up 5.9 percent from 241,920 in January 2023.

January’s statewide median home price was $788,940, down 3.8 percent from December and up 5.0 percent from $751,700 in January 2023.

Year-to-date statewide home sales were down 5.9 percent.
