With the traditional wildfire season ramping up and numerous wildfires breaking out across the state, C.A.R. is reminding members about the C.A.R. Disaster Relief Fund. The Disaster Relief Fund provides grants for REALTORS®, employees of REALTORS® and association staff who have experienced property damage and/or loss due to wildfires, or suffered from a recent natural disaster. NAR CALL FOR ACTION: Protect Independent Contractor Status

The National Association of REALTORS® has launched a CALL FOR ACTION asking Members of Congress to cosponsor H.R. 5419 the Direct Seller and Real Estate Agent Harmonization Act, to ensure real estate agents maintain their independent contractor status under the Fair Labor Standards Act (FLSA).

In California, 85% of real estate agents choose to do business as independent contractors. C.A.R. successfully included provisions in state laws and regulations, including AB 5, protecting REALTORS® ability to work as independent contractors. Effective Aug. 12

CCAR has posted new MLS Rules & Regulations which will be effective August 12, 2024. These system changes reflect the work of the CCAR MLS Management Group (MMG) which has spent the last few months reviewing the rules in their entirety to ensure compliance with NAR and C.A.R. model MLS rules changes resulting from the NAR legal settlement. Ethics Advocates Your Most Valuable Resource in a Dispute

An Ethics Advocate (EA) is a no-cost resource available upon request, supporting complainants and respondents involved in disciplinary proceedings. Ethics Advocates, who are trained Professional Standards volunteers, assist parties throughout the process. They help with concise form preparation, gathering evidence, and can provide support during hearings if requested.

While EAs are not attorneys and cannot practice law, they aid parties in presenting their case effectively, including completing Complaint and Response Forms and identifying relevant evidence. EAs do not act as witnesses during hearings. Although individuals must attend hearings themselves, an EA offers valuable assistance before, during, and and after the hearing. It’s important to note that using an EA does not preclude parties from retaining their own legal representation if desired.

California Latest Market Update – July 29

The economy expanded at a faster pace than expected in Q2, but the latest growth rate could be the highest we will see in the next few quarters. There are signs in recent months that suggest consumers are increasingly tapped out and could pull back further in coming months. An economic slowdown, however, is not necessarily bad news for the housing market. Mortgage rates, in fact, started this week at six-month lows, as the market has become more convinced that the Fed’s rate cuts will begin in September. Home sales should begin to bounce back and improve more consistently in Q3 and Q4.

CCAR Lends a Helping Hand to Disaster Victims

CCAR’s Helping Hands Committee has donated $5,000 to the National REALTOR® RELIEF FOUNDATION (RRF) in support of its 2024 efforts to provide housing relief to victims of hurricanes, floods, wildfires and other disasters.

RRF is a 501(c)(3) nonprofit that provides financial housing assistance to the public following catastrophic disasters. The foundation has donated more than $37 million in aid helping tens of thousands of families across the country.

Every dollar donated goes directly to victims of disasters. The National Association of REALTORS® is pleased to cover 100% of administrative expenses.

New Forms Released July 24;
Town Halls Continue Till End of Week

New C.A.R. forms will be released in zipForm® and other forms platforms on July 24. It is imperative that members are ready to use the new forms and prepared to discuss the changes with their clients to be in full compliance by the August 17 deadline when the mandates of the NAR settlement go into effect.

C.A.R. will continue to provide forms training this week (link to registration below). Additionally, C.A.R. Education will offer two new classes on settlement-related forms: a Buyer Representation Form class and a Residential Listing Form class.

Members can access the classes for FREE by logging into store.car.org and entering “FORMS49” at checkout. Class details and codes will be emailed to all members and will also be available on store.car.org.

C.A.R. Ombudsman Volunteers On Call to Answer Non-Legal Questions

C.A.R. Ombudsmen are REALTORS® who volunteer to handle non-legal questions, disputes, and complaints about member conduct or transactions. They aim to enhance communication among REALTORS® and can propose resolutions for minor issues raised by clients or other members.

The C.A.R. Ombudsman Hotline, is provided free of charge to C.A.R. members. Ombudsmen function as impartial volunteers who facilitate communication, suggest potential solutions, and help prevent misunderstandings from escalating into larger disputes. They do not mediate or adjudicate disputes nor can they compel either party to take specific actions.

Latest inflation data continued to provide hopes that the Fed could begin cutting rates in the near term. The financial market has been reacting positively to the good news and consequently led to mortgage rates dropping more than 30 basis points since early July. With rates trending down in recent weeks, the housing market is seeing more buyers and sellers reentering the market. The momentum could continue if rates begin declining more consistently, and July could become the turning point of a strong second half for the housing market.

Inflation reaches the lowest level in more than three years: A drop in energy prices and a modest increase in food prices led to the first monthly decline in the consumer price index (CPI) since May 2020. The June headline CPI declined 0.1% from the prior month and was up 3% from the same month last year. Excluding energy and food prices, the core CPI rose 0.1% from May and 3.3% from a year ago. C.A.R. stands ready to assist REALTORS® who have been impacted by natural disasters through its Disaster Relief Fund. The Association established the fund in the wake of the 2003 California wildfires. Grants provided by the fund are used to help members of the REALTOR® family — REALTORS®, their staff, and Association members and their staff — who have incurred substantial losses due to wildfires and other disasters.

It is with heavy hearts that we announce the passing of Jo Carlson, a cherished member of CCAR and the real estate community with over 46 years of dedicated service. She spent many years with Christie’s International Real Estate Sereno, where her professionalism and commitment left an indelible mark. Jo’s outstanding contributions to the industry were recognized with the prestigious Honorary Member for Life distinction from the California Association of REALTORS®. She was also a proud member of the Woman’s Council of REALTORS® and was honored by being elected to the Contra Costa Real Estate In Motion (CCRIM) Hall of Fame. There will be a Celebration of Life honoring Jo on August 15 at 4pm at the Pleasant Hill Community Center.

The short-term outlook for the housing market looked slightly more positive as interest rates moderated throughout the month of June and the supply condition continued to improve in the past couple of months. With the job market showing signs of cooling in recent weeks and consumers feeling less positive about their future financial well-being, the economy could slow further in the next two quarters. While the growth momentum could be cooling off for the U.S. economy, the housing market could benefit from the slowdown if the Federal Reserve reacts accordingly and starts reducing the policy rates in the near term.
