November 2022 State and Local Measures Election Results

Below are the results for state and local measures from the November 8, 2022 elections.

2022 STATE BALLOT MEASURES:

PROP 1: Abortion Constitutional Amendment
- PASSED

Placed on the ballot by the legislature, this measure codifies existing state law into the California Constitution to guarantee the right to have an abortion and to choose or refuse contraceptives.

  • Supporters: Planned Parenthood Affiliates of California, League of Woman Voters California, and California Medical Association
  • Opponents: California Conference of Catholic Bishops, California Alliance of Pregnancy Care, and International Based Coalition

Prop 26: In-Person Sports Wagering - FAILED

Led by the Pechanga Band of Luiseño Indians, this measure if approved would allow sports wagering at horse racetracks and tribal casinos while authorizing private right of action lawsuits against non-tribal gaming operators.

  • Supporters: Pechanga Band of Luiseno Indians, NAACP California, and California District Attorneys Association
  • Opponents: California Hispanic Chamber of Commerce, California Black Chamber of Commerce, and AFSCME

Prop 27: Online Sport Wagering - FAILED

Led by DraftKings, FanDuel, BetMGM and others, this measure authorizes online only sports wagering and dedicates new tax revenue to address homelessness and mental health services.

  • Supporters: FanDuel, DraftKings, BetMGM, Middletown Racheria Pomo Indians, Darrell Steinberg (Mayor of Sacramento)
  • Opponents: 50+ California Indian tribes, NAACP California, CalAsian Chamber of Commerce

Prop 28: Funding Allocation for Arts and Music - PASSED

With a star-studded coalition, this measure dedicates one percent of the state’s general fund for public school arts and music programs.

  • Supporters: Austin Beutner (former LAUSD Superintendent), California Teachers Association, California State PTA
  • Opponents: No opposition arguments were submitted

Prop 29: Dialysis Worker Unionization - FAILED

This measure is SEIU-UHW’s third attempt to unionize kidney dialysis clinics since 2018.

  • Supporters: SEIU-UHW, California Democratic Party
  • Opponents: California Medical Association, California Chamber of Commerce, California Taxpayer Protection Committee

Prop 30: Income Tax Increases for EV Subsidies
- FAILED

Another Lyft backed initiative, Prop 30 increases income taxes by $4.5 billion annually to fund electric vehicle and charging station subsidies.

  • Supporters: CalFire State Firefighters, American Lung Association, California Democratic Party
  • Opponents: Howard Jarvis Taxpayers Association, Governor Gavin Newsom, California Teachers Association

Prop 31: Flavored Tobacco Ban
- PASSED

The referendum challenging a 2020 law prohibiting the sale of flavored tobacco and harm reduction products.

  • Supporters: Michael Bloomberg, American Heart Association, NAACP California
  • Opponents: California Hispanic Chamber of Commerce, CalAsian Chamber of Commerce, Central Valley Business Federation

2022 LOCAL BALLOT MEASURES:

City of Pleasant Hill: Measure M (majority required to pass)
- PASSED

Measure M is asking voters whether the City Treasurer should become an appointed office (as opposed to an elected office).

City of Hercules: Measure N (majority required to pass)
- PASSED

Measure N is asking voters to extend the existing User Utility Tax (UUT), a pre-existing measure that has already been approved by voters in two previous elections.
  • CCAR was opposed to the initial plan to ask residents to approve the city becoming a Charter City for the sole purchase of establishing a real estate transfer tax. This measure was the alternate choice to the charter city.

City of Walnut Creek: Measure O (majority required to pass)
- PASSED

Measure O is asking voters to approve a half cent (1/2 cent) sales tax to support Walnut Creek city services, replace aging facilities, and help maintain the community’s lifestyle. This measure would sunset in 10 years.

City of Richmond: Measure P (majority required to pass)
- PASSED

Measure P is asking voters to approve amending the existing Richmond rent control ordinance by capping the annual allowed rent increase at 60% of the inflation rate or 3%, whichever is lower

C.A.R. Red Alert: Oppose New Property Taxes!

C.A.R. OPPOSES Senate Bill 1105 (Hueso) and Senate Bill 679 (Kamlager) each of which creates an unelected agency with the power to impose a range of new property taxes. Those taxes would make keeping and getting into a home more expensive and difficult, potentially taxing people out of their homes and pushing homeownership out of reach for many of California’s working families. We need YOUR help to STOP these bills!

SB 1105 (Hueso):

SB 1105 grants vast, unchecked, taxing and bonding authority to an unelected Housing Agency Board in San Diego which would consist of 6 appointed representatives, serving 4-year terms that can by resolution, or initiative, impose: 

  • special taxes on real property,
  • a parcel tax,
  • a gross receipts business license tax,
  • a special business tax,
  • a documentary transfer tax,
  • a special land value windfall tax, or
  • a commercial linkage fee.

The proposed Agency requires revenues generated to assist in the construction of housing broadly defined. Revenue which could go to large developers of rental homes and no restrictions on the agency purchasing single family homes which could then further limit the opportunities for home ownership. The costs of solving California’s housing problems should not be placed on working Californians struggling to stay afloat and keep their homes in a tough economic environment, especially when there is a 97 billion dollar state surplus.

 

SB 679 (Kamlager):

SB 679 would establish a local Housing Agency in LA with a 19 member “governing board” to raise revenues through: 

  • a parcel tax
  • gross receipts business license tax
  • a document transfer tax, or
  • the issuance of bonds to fund affordable housing preservation (acquiring, rehabilitating, deed restricting, etc.).

Sellers in High Fire Zones Required to Disclose

As of January 1, 2021, sellers are required to complete the Fire Hardening and Defensible Space Advisory (FHDS) should their property fall within a high to very high fire hazard zone; built before 2010; residential one to four properties; condominiums or other common interest development units; or manufactured homes. If the seller is not sure, there is a state website where the property address can be inputted to determine if the property does fall in high to very high fire zones.

Fire is a constant risk in California. Be sure to confirm with sellers whether their properties lie within high to very high fire zones. To identify fire zones, visit: Fire Hazard Severity Zones Maps.

In addition to the FHDS requirements, as of July 1, 2021, homeowners are required to also maintain a defensible space between a structure on the property and any flammable grass, trees, shrubs, or wildland area that surround it. Sellers of these properties will need to provide documentation that their property is in compliance with the defensible space laws, or the buyers will be required to agree to obtain such documentation of compliance in the future. 

For the buyer to take on the responsibility, they will need to contact their local Fire District to request an extension to complete the work.

Fire Districts in Contra Costa County request that inspection requests be placed as soon as the seller intends to place the listing on the MLS as it can take a week for the Fire District to respond to the requestor even make it out to the property. The Fire Districts also request that the property owner is at the inspection to discuss any concerns the Fire District might have regarding the property at that time.

 

The seller will need to determine which jurisdiction their property falls, either the local municipality or a Fire Protection District.

Recently the San Ramon Valley Fire Protection District (SRVFPD) created an application to assist its residents in determining if their property falls within a high to very high fire zone. The application is called ArcGis Explorer which is available for both Apple and Droid phones in the app stores. Once the app is downloaded, SRVFPD’s coverage map is titled “Defensible Space Inspection Requests.” This map will allow residents to input the address and determine if the property falls in a high or very high fire zone. This map can also be accessed through SRVFPD website here or via the state map here.
