NAR: Guidelines for 1-to-1 Broker Communication
NAR has released new guidance on one-to-one broker communications and the Clear Cooperation Policy. This resource is intended to provide clarity and additional information about the distinction between permissible one-to-one broker communications and activities that may trigger Clear Cooperation Policy requirements. In general, one-to-one communication between a listing broker or agent and another broker or agent outside the listing brokerage may be permitted when it is authorized by the seller and supports the seller’s informed consent and best interests.
The guidance also explains that while one-to-one conversations may not trigger Clear Cooperation Policy requirements on their own, certain activities can go beyond communication. Examples include sharing an office exclusive listing with multiple brokerages, arranging showings or tours, engaging in negotiations, accepting offers, or having the recipient share the information with others. These types of activities may require the listing to be filed with the MLS within one business day.
Members are encouraged to review the full document to better understand what is allowed, what may trigger MLS filing requirements, and how to ensure communications remain consistent with the seller’s privacy, security, and best interests.
