CA Law – Sexual Harassment Training Required Every 2 Years

Designated Brokers Must Complete Supervisory Sexual Harassment Training + Provide Employees with Access to Training

Employers/Designated Brokers:
If you employ 5 or more employees (including temporary and seasonal workers) you are legally obligated to complete supervisory sexual harassment training AND provide access to sexual harassment training for all those who work for you.

Employees:
If you are a full time, temporary and/or seasonal worker, you must complete 1-hour of sexual harassment training immediately, and 1-hour every 2 years hereafter to comply with new State legislation.

Salespeople, Brokers, Broker Associates and Independent Contractors:
You are now liable for sexual harassment in your professional relationships with your clients (whether they have terminated your relationship, or not). Therefore, C.A.R. recommends that you complete 1-hour of sexual harassment training immediately, and 1-hour every 2 years, hereafter.

September Paragon Enhancements

Performance Improvement

In September the following enhancements will be implemented in the Paragon 5 MLS. These changes will enhance your user experience and increase the amount of data at your fingertips! Enhancements include: IDX Broker Attribution (Required by September 1st) and changes to MLS Area & Tour Group (Go into effect September 12th.) 

Paragon 5 MLS Updates (IDX Listing Broker Attribution, MLS Area & Tour Group Changes)
 

Currently, our Internet Data Exchange (IDX) and Virtual Office Website (VOW) rules require displaying the Listing Agent and Listing brokerage name attribution. The National Association of REALTORS® (NAR) has amended the policy with the additional attribution of adding a phone number or email address. The required implementation date for IDX vendors to include the additional attribution is September 1, 2022.

Brokers, if you would like to make your selection that controls the additional attribution requirements you can do so be following the below steps:

  1. Log into Paragon 5
  2. Select “System” on the “Preferences” drop-down menu
  3. Select “IDX / VOW Contact Info” on the left side menu
  4. Choose your selection on the drop down menu and click “Save”.

MLS Area & Tour Group Changes (Effective September 12th):

To ensure increased accuracy of search results and mitigate the usage of certain fields, the following changes will be made to the default searches for all property classes, Open House/Tour searches, and result views.
 
Default Searches (All Property Classes):
The “MLS Area” field will be removed from the default search templates for all property classes. We highly recommended using city or the map search if you are not already. The field will still be available and if you would like to continue leveraging this search filter you can customize your search template.
 
Open House/Tour Searches:
The “Tour Group” field will be removed from the default Open House/Tour search template.
 
Report Views:
The MLS Area field will be removed from the following report views:
Agent 2-Page (New)
Client 2-Page (New)
Agent Report (New)
Client Report (New)
 
The “Tour Group” field will be removed from all tour report views and the “Tour” action icon will be removed from all report views.

Compliance “Did You Know” – Churning

Did you know there is an approved approach to giving your listing a fresh start in the MLS? “Churning” is not only permitted when the required steps are followed, it can be very useful when dealing with a slow market or home improvements. 

To “Churn (relist)” a property in the MLS simply follow these steps.
  1. Execute a new listing agreement and MLSA by emailing a completed MSLA form (found in zipForm®) to CCAR at [email protected]
  2. Update the status of the existing listing in the MLS to “Withdrawn – Cancelled”
  3. Wait 30 days
  4. Input a new listing and the CDOM and CDMLS will start at zero
7.26 Churning of Listings/Relisting. Manipulation of listing data which misleads the public, participants and subscribers, is not permitted. Only when the listing Participant/Subscriber has signed a new listing agreement with the seller, shall the Participant/Subscriber be permitted to relist the property in the MLS as a “new” listing. Only when a property has been off the market for more than thirty (30) days will the days (CDOM and CDMLS) on the listing start at zero (0). This applies regardless of withdrawals, cancellations, extensions, expiration and /or other modifications to listing agreement.
